A Lakewood man has been sentenced to 42 years in prison for the death of his 3-month-old daughter.

Kelly Ray Kerr, 39, appeared in Jefferson County District Court on Wednesday and was sentenced after being convicted in March of child abuse resulting in death, according to the district attorney’s office.

In March, the jury deliberated for less than two hours, after a five-day trial, in finding Kerr guilty in the death of his daughter Olivia. Kerr was sentenced Wednesday by Judge Randall Arp.

“In an unspeakable act of violence, Mr. Kerr took the life of a precious 3-month old baby,” DA Pete
Weir said. “He has earned every day of the sentence imposed by Judge Arp.”

On July 21, 2017, police were called to a home in the 10500 block of W. 26th Ave. on a report of a child not breathing. Kerr was the primary caregiver for Olivia while her mother was at work, according to a news release.

Kerr had called Olivia’s mother — it took 17 minutes for him to contact her — to report that Olivia was not breathing, prosecutors said. The child’s mother then called 911 for help.

Olivia was taken to Lutheran Medical Center and then to Children’s Hospital Colorado, where she died of her injuries. Olivia had suffered a major skull fracture, a secondary skull fracture, bilateral retinal hemorrhages, multiple rib fractures and bruising on her face and jaw, according to the release.

She died of blunt force trauma, according to the coroner’s office. At trial, an expert testified that Olivia’s injuries were consistent with being abusively shaken.
